When writing a reference it is essential to be 100% factual (remember that an employee can ask to see a reference), otherwise you face legal risks.  
  • An incorrect negative reference could result in an individual commencing proceedings against you for defamation of character.
  • A glowing reference for an individual that doesn’t then live up to expectations could result in the new employer suing you for damages.  To help prevent this we recommend including a disclaimer at the bottom of your reference.
